1. Who We Are and How These Terms Work
Leredd.com is in the business to make you a healthier you. By using the Leredd.com website (and mobile site) and our social media pages ("Website"), and/or by attending our clinic and receiving services, you accept these terms and conditions ("Agreement") and our Privacy Policy. This Agreement is between you and the company trading as LEREDD under ABN 99 286 533 568 (referred to in this Agreement as "we", "us" or "our").
We may change these terms at any time and changes will be posted on the Website and/or made available at our clinic. By continuing to use the Website, purchase our products or attend our clinic after any change, you agree to be bound by the changes.
2. Scope of This Agreement
These terms apply to:
- Your use of our Website and social media pages.
- Your registration and use of any online account with us.
- Your purchase of any goods, devices or services from us (online or in-clinic).
- Your attendance at, and receipt of treatments at, our clinic located at 1/99 Brewer Road, Bentleigh VIC 3204.
If there is any inconsistency between this Agreement and any specific written consent form or written agreement you sign at the clinic, the more specific document will prevail to the extent of that inconsistency.
3. Registration and User Requirements (Website)
You must be a registered member to access some features of the Website or our services. When you register, you will provide us with personal information including your name, address, and a valid email address. You must ensure this information is accurate and current.
By using the Website and its associated functionality, you grant your express consent to us to send you direct marketing communications to the email address you provide, from which you may unsubscribe at any time. Your consent to receipt of certain communications may be implied from the use of certain functional aspects of our service, such as receiving reminders that items are in your shopping cart if you leave the page during a transaction.
To register an account or to use the Website you must be at least 18 years old and have capacity to enter into a legally binding agreement with us.
The limited warranty for our products applies to consumer use only and does not apply when a product is used in a commercial or institutional setting.
4. Access and Use of the Website
You must only use the Website through the interfaces provided by us and in accordance with this Agreement and any applicable law.
You must not (or attempt to):
- Interfere or disrupt our site or the servers or networks that host our site.
- Use data mining, robots, screen scraping or similar data gathering and extraction tools on our site.
- Interfere with security-related or other features of our site.
- Use, copy or distribute content without our express permission.
We may refer fraudulent, abusive or illegal activity to the relevant authorities.
If you have an account with us, you are solely responsible for the activity that occurs on your account (including orders placed using your account), and you must keep your account password secure. We are not responsible for any unauthorised activity on your account if you fail to keep your login information secure.
You must not use another member's account without our and/or the other user's express permission. If you suspect or become aware of any unauthorised use of your account or that your password is no longer secure, you must notify us immediately and take steps to re-secure your account.
We do not warrant that the Website will be available at all times and without disruption and we provide no warranties in relation to the content of any other website linked to or from our Website.
5. Information on This Website and General Health Information
You agree to make your own enquiries to verify information provided and to assess the suitability of goods or services before you order the goods or services.
If asking questions online via the 24-hour/7-day chat bot option you understand that the information provided back to you is only general in nature and may not be the most accurate answer to your question. You should not rely on it and should always contact the company via email with your questions for full accuracy. For full and proper answers we have an online consultation option that you can book online via our Website.
Due to photographic and screen limitations associated with the representation of goods, some actual goods may differ to a small extent in visual appearance (for example in colour) from the way they appear on the Website. Some depictions of products or services are created or chosen for promotional purposes and may not be an exact representation of the product received.
Information is provided for education purposes only. The information on this Website is presented by LEREDD for the purpose of disseminating health information free of charge for the benefit of all those considering using light therapy in the ranges of 425 nm to 1070 nm wavelengths.
While LEREDD has exercised due care in ensuring the accuracy of the material contained on this Website, the information on the site is made available on the basis that LEREDD is not providing professional advice on a particular matter. Much of the research is scientific and concluded at that level by scientists across the globe over many years and on an ongoing basis.
This Website is not a substitute for independent professional advice. Nothing contained in this site is intended to be used as medical advice and it is not intended to be used to diagnose, treat, cure or prevent any disease, nor should it substitute for your own health professional's advice.
Therefore, LEREDD does not accept any liability for any injury, loss or damage incurred by use of or reliance on the information provided on this Website.
Our products are considered minimum-risk, general wellness and fitness products in accordance with the "General Wellness: Policy on Low Risk Devices" document released September 27, 2019.
6. Clinic Services and Client Obligations
6.1 Services Covered (Clinic)
These Terms and Conditions apply to all services provided at LEREDD's clinic, including:
- Photobiomodulation (PBM); red light therapy;
- Collagen induction therapy (CIT) microneedling (cosmetic, non-surgical skin needling);
- IPL (intense pulsed light) treatments for skin rejuvenation and pigmentation;
- IPL SHR permanent hair reduction/removal;
- Non-invasive facials (including but not limited to hydrating, anti-ageing, LED and similar facials);
- Micro-dermabrasion;
- Facial analysis and skin screening (including digital imaging, photography, and automated or manual assessments) and any related consultations, product recommendations and home-care product sales.
All services are cosmetic and non-surgical and are not a substitute for medical care by a registered health practitioner.
6.2 General Client Obligations
By making a booking or proceeding with a treatment you:
- Confirm you are at least 18 years of age, or you are a parent/guardian providing consent for a person under 18.
- Agree to provide complete and accurate medical, medication and lifestyle information, and to update us if anything changes between appointments.
- Agree to follow all pre-treatment and post-treatment instructions provided verbally or in writing.
- Acknowledge that outcomes vary between individuals and that no specific result, degree of improvement, or number of sessions can be guaranteed.
- Acknowledge that all services are cosmetic and non-surgical and do not replace medical diagnosis or treatment from a registered medical practitioner.
6.3 Contraindications and Medical Conditions
You must inform us, before each treatment, if any of the following apply or change:
- Pregnancy or breastfeeding.
- History of keloid scarring, abnormal wound healing, active infections, or autoimmune conditions.
- Use of photosensitising medications (for example certain acne medications, some antibiotics, or herbal supplements).
- Recent use of isotretinoin or similar oral acne medications (within the past 6–12 months – the exact period will be clarified at consultation).
- History of epilepsy or light-induced seizures (particularly relevant for PBM and IPL).
- Active skin conditions in the treatment area such as eczema, psoriasis, dermatitis, cold sores, rashes, cuts, sunburn, or open wounds.
- Any implanted medical devices or metallic implants in or near the treatment area (relevant for some devices).
- Any history of skin cancer, suspicious lesions or changes in moles in the treatment area, which must be reviewed by a medical practitioner prior to any cosmetic treatment.
We reserve the right to decline or postpone treatment if we consider it to be unsafe or unsuitable for you, or if you have not followed pre-treatment instructions.
6.4 Treatment-Specific Notices
Photobiomodulation Red Light Therapy (PBM)
PBM uses low-level light to support local circulation, reduce inflammation and support general skin health and wellbeing. PBM is not a medical treatment for any diagnosed disease, is not a substitute for medical care, and no claims are made regarding cure or prevention of specific medical conditions. You may be asked to remove makeup, creams or topical products and wear protective eyewear as directed.
CIT Microneedling
CIT microneedling involves controlled puncturing of the skin using extremely fine needles to stimulate collagen and improve skin texture, appearance of scars, and general skin quality. You acknowledge there may be temporary side effects including redness, swelling, pinpoint bleeding, bruising, flaking and increased photosensitivity. You agree to follow strict aftercare, including: avoiding sun exposure and heat, using only recommended products, avoiding active ingredients (such as strong acids or retinoids) for a specified period, avoiding picking or scratching, and using sunscreen as directed. You understand results typically require a series of treatments and may not completely remove scars, lines or pigmentation.
IPL Skin Treatments
IPL uses broad-spectrum light directed at skin structures to address pigmentation, redness and other cosmetic concerns. You will be required to undergo a consultation and patch test before the first full treatment. You must avoid tanning (natural sun or solarium), self-tanners and unprotected sun exposure on treatment areas for the period advised before and after treatment. Possible side effects include redness, swelling, blistering, temporary darkening of pigment, lightening of skin, burns, crusting or scabbing. IPL is not a skin cancer screening or treatment; suspicious lesions must be assessed by a medical practitioner before any cosmetic procedure.
IPL SHR Permanent Hair Removal
SHR (Super Hair Removal) uses repeated, low-energy light pulses to reduce hair growth over time. You understand hair growth occurs in cycles and multiple sessions are required for best reduction, and that complete or permanent removal of all hair cannot be guaranteed. You must avoid waxing, plucking, threading or epilating in the area for a minimum period prior to each session; shaving is generally permitted and may be required. You must avoid tanning and follow all pre- and post-care directions to minimise risk of burns, pigment changes or other complications. Under 18s will only be treated with written parental/guardian consent and may be restricted to certain body areas at our discretion.
Non-Invasive Facials
May include cleansing, exfoliation, masks, LED, light vacuum or microcurrent technologies and topical products. You acknowledge there may be mild temporary redness or sensitivity and that skincare actives will be selected based on the information you provide. If you have allergies or sensitivities, you must inform us in advance so that appropriate products can be selected or a patch test performed.
Micro-Dermabrasion
Uses mechanical exfoliation to refine skin texture, congestion and tone. You may experience temporary redness, mild swelling or flaking after treatment. You agree to avoid sun exposure, heat, abrasive products, waxing and strong active ingredients in the treated area for the period advised after treatment.
Facial Analysis and Screening
Facial analysis may include digital photographs, imaging, UV or other non-invasive technology to assess skin condition. The assessment is cosmetic in nature and is not a medical diagnosis, nor a replacement for assessments by medical practitioners or dermatologists. Images and analysis data may be stored securely in your client record to monitor progress over time. You may withdraw consent for future imaging at any time, but existing records may be retained as part of your clinical file in accordance with our privacy obligations and record-keeping requirements.
7. Informed Consent (Clinic)
Before proceeding with treatment, you will:
- Receive information about the nature, purpose, expected benefits and potential risks and side effects of the proposed treatment.
- Have the opportunity to ask questions and consider alternative options, including not proceeding.
- Be asked to sign a consent form specific to the treatment (for example, PBM, microneedling, IPL, IPL SHR hair removal, micro-dermabrasion) confirming you understand and agree to proceed.
You may withdraw your consent and request to stop a treatment at any time; however, fees may still be payable for time and resources already used.
8. Product Consultations (Online or In-Person)
Consultations booked online whether by Zoom or in person will be 30 minutes in duration and charged at a rate of AUD 45.00, payable by credit card and prepaid at time of booking.
This charge is redeemable if a product or products are purchased to a total value of AUD 100.00 or greater within 14 days of the consultation. If you do not attend the consultation at the time booked for whatever reason ("no show") you agree and understand that the charge will not be refunded and that you have waived your rights in this instance.
Should you wish to cancel and/or reschedule your appointment, this must occur no less than 48 hours prior to the designated appointment time. If cancelled within 48 hours of the appointment time, no refund will be applied.
9. Pricing, Payment and Clinic Packages
All clinic prices are in Australian dollars and inclusive/exclusive of GST as stated. We reserve the right to change pricing at any time; however, confirmed bookings will be honoured at the price quoted at the time of booking. Payment is due at the time of treatment unless otherwise agreed.
Pre-paid packages or courses of treatments are non-transferable and non-refundable except as required by Australian Consumer Law. Pre-paid sessions must be used within the validity period communicated at the time of purchase; unused sessions may be forfeited after expiry unless required otherwise by law.
10. Clinic Cancellations, Late Arrivals and No-Shows
We may require a deposit or card on file to secure bookings; this will be communicated at booking.
If you need to cancel or reschedule a clinic appointment, you must provide at least 24 hours' notice. Cancellations or reschedules with less than the required notice, no-shows, or repeated last-minute changes may result in a cancellation fee or forfeiture of a pre-paid session.
If you arrive late, your appointment may be shortened to avoid impacting other clients and the full fee may still apply.
11. Placing Orders (Products and Vouchers)
You are responsible for any discrepancies or errors in your order caused by you.
The promotion of goods or services on the Website does not constitute an offer to sell. It is an invitation only.
Orders placed by you are offers to purchase either:
- A voucher for particular goods and/or services under the terms and conditions in this Agreement at the price specified (including delivery and other charges); or
- Goods under the terms and conditions in this Agreement at the price specified (including delivery and other charges).
Goods sold by Leredd.com are not reserved in-cart, and an order is only finalised when you have completed checkout, payment is received in full, and you have received an order confirmation from us.
We use automated fraud detection software that may result in your order being delayed or cancelled. Where your order is flagged for fraud detection, we will make enquiries into any potential fraud. We reserve the right to reject and refund your order at our absolute discretion where fraud is suspected.
Your order may be rejected in circumstances where we believe there may be a credit card or payment-related fraud (detected prior to the goods being shipped), where your order cannot be shipped, or if there has been an error in the price or product description on the Website. In these circumstances the order will be refunded in full minus any administration costs in assessing the order.
You must review your order carefully before placing it. A checkbox at Checkout is to be marked by you after you have read and agreed with this Agreement and also the Refund and Returns Policy. It is not possible to proceed with order placement via the online checkout without checking the box. Once checked, it is accepted by you that you have read and agreed to all Terms and Conditions and policies on the Website.
Once an order is confirmed, you are unable to cancel or change it. If you have any problems with your order, then you must go through the normal returns process outlined in this Agreement. We do not accept change of mind as a valid reason for a cancelled order.
In the event that we cancel or are unable to fulfil your order, we will provide a full refund of any payment received. We may notify you that goods for which you placed orders have become unavailable for reasons beyond our control. Your order may be delayed, or you may receive a full refund or store credit (at your election) in the event we cannot fulfil your order.
12. Guest Checkout
You can make purchases on our Website without creating an account by using our Guest Checkout.
When you use Guest Checkout, we will collect any personal information you provide, including your name, email, phone number and delivery address, in accordance with our Privacy Policy.
13. Prices, Payment, Sales and Discount Codes (Products)
The base prices of goods, delivery and other charges shown are in Australian dollars. GST will be applied at checkout for Australian customers. Conversions may be shown on the site to your local currency depending upon which country you access the Website from.
At various times throughout the year we may conduct special sales events. The listed pricing will show as a sale price and these prices are only valid and applicable to the sales event at that time and may be changed at any time at our discretion. To secure a sale price simply place and pay for your order at that time.
All payments must be received in full prior to dispatch of goods or a voucher being issued. If your payment is not received or is declined, we cannot and will not hold items against your order.
A discount code is only valid for a single transaction and may not be used in conjunction with any other discounts unless expressly stated.
14. Online Chat
We operate a 24/7 online chat for general enquiries and the responses provided by the chat operator are only general in nature and may not be fully accurate or offer the most complete reply to your needs.
Any pricing questions placed with the online chat may return an incorrect number and we suggest always checking the product page for accurate pricing at the time of your enquiry. If there are any inconsistencies between the online chat response and the actual product listing page, then you must refer to the product listing page for complete accuracy.
15. Affiliates
Coupon Code Companies (CCC's) and commercial operators that operate in a similar vein that sign up as Affiliates understand that they must be able to provide a financial benefit better than what the customer would have otherwise obtained than purchasing direct from the company, otherwise the introduction is of no financial benefit to the customer. In such cases, no commission will be allocated.
CCC's should not advertise coupons such as "free shipping coupons" if the products already include free shipping as standard in the displayed pricing.
Commissions can vary and it is at our sole discretion what percentage is paid at any given time. The Affiliate program is intended to be transparent and honest, whereby Affiliates who organically promote the company's products receive fair remuneration and can supply their customers at a better-than-advertised rate when compared to Website pricing at that time.
Commissions are only payable for new customers introduced by the Affiliate, not repeat orders from the same customer. Self-referrals and referrals to the same delivery address will be treated as normal sales and no commissions are rewarded.
16. Direct Import Goods and International Duties
By purchasing goods and importing them into your country you may be required to comply with the laws and standards that apply to the importation of such goods and pay customs, duty and/or local taxes.
LEREDD does not pre-pay any international customs fees, duties or sales tax/VAT of any kind, nor any broker fees associated with importation. Any and all import, duty, broker fees and taxes must be paid by the receiver. You are responsible for checking with your country's customs/enforcement body to ascertain these fees. USA tariffs are assessed and charged accordingly at checkout based upon the ordered products and they form part of the total paid. Leredd will be invoiced separately for these by the government registered authority and will make that payment directly.
Any shipment that was shipped correctly but is subsequently refused by the recipient, unable to be delivered with the customer-supplied address or returned to our warehouse will incur a flat AUD 200 fee per carton/box for shipping/warehousing/receiving charges plus an additional 30% restocking fee on the original purchase price. Shipping fees are non-refundable.
Australian customers generally do not have to pay further costs if the items purchased are in stock in our Australian warehouse. However, if some items are not in stock and are shipped directly from our overseas warehouse, some products or orders that exceed the low-value import threshold may attract additional GST or charges from Australian Customs and Border Force.
17. Store Credits
If you have an account with us, any unused portion of your store credit will be credited to your account.
We may change any of the terms and conditions in relation to store credit upon reasonable notice, including by notice on the Website.
Store credits expire after 12 months from the date of issue unless otherwise stated. Store credits issued for promotional or goodwill purposes will usually expire after 3 months.
Store credits cannot be redeemed for cash or used for the purchase of gift cards. Where a minimum spend applies to any promotional event, store credits do not count towards the minimum spend.
18. Shipping and Delivery
Subject to this Agreement, goods will be supplied as shown on your order confirmation, which will be provided to you by email.
We will use best endeavours to meet stated timeframes for delivery, however shipping service providers may suffer delays beyond our control. Please allow up to 30 days for delivery (for standard and international courier).
Certain goods (including large and bulky items or special orders) may be subject to additional charges, which will be shown at checkout (excluding any taxes/duties charged by authorities).
Express shipping is available in most areas and for certain orders; eligibility will be confirmed at checkout.
For goods sold by LEREDD, orders may not require signature and may be left in a safe place at your delivery address in accordance with carrier practice. A signature may be required for some deliveries. You must ensure you can accept delivery.
Leredd is not responsible for:
- Early/late delivery where attempted delivery has occurred on or before the stated time-frames.
- Lost or missing parcels that have been signed for at your selected delivery address (whether or not you personally accepted delivery).
- Lost or missing parcels left at your chosen location where you gave authority to leave.
We reserve the right to change, modify or discontinue any delivery options at our discretion.
19. Packaging, Labelling and Instructions
We endeavour to depict goods using accurate images. Actual goods may differ in appearance and packaging to a small extent from their appearance in images and photographs on the Website.
We recommend that you read all instructions prior to using any of the products and follow them carefully.
20. Australian Consumer Law and Your Rights
The Australian Consumer Law (ACL) provides consumer guarantees that cannot be excluded for goods and services. Our products come with guarantees that cannot be excluded under the ACL.
You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
Consumers do not have a right to return a product where they:
- Change their mind and no longer want the product.
- Order the wrong product.
- Find the product cheaper elsewhere or believe another product is better.
- Damage the product by misusing it.
- Use the product for an extended time and the problem is due to normal wear and tear.
21. Warranty and Returns – Problems with Your Goods
If you have a problem with the quality or operation of your goods and wish to return them for assessment you need to complete the appropriate form on the refund and returns page: https://leredd.com/refund_returns/
We will investigate and advise whether your product may be returned and provide instructions, including which warehouse (Australian or South-East Asian) to return to and at what cost if applicable.
If an item is authorised for return, we will inspect and/or send it to third parties for assessment/repair. Where applicable we will provide a remedy.
If we do not believe a remedy is applicable (for example where we believe the goods have been misused, not used in accordance with instructions, used abnormally, or reasonable care has not been taken), we will reject your claim and return your goods to you. You must cover the cost of return shipping in that case.
When returning a non-defective product that falls within returnable guidelines, you are responsible for all costs of shipping the products back to us. International shipping charges are non-refundable. Products must be returned in original packaging with all accessories or the shipment may be refused.
A refund may be issued after the product is received and inspected for damage or missing accessories. If returned damaged or in unsellable condition, the shipment may be refused/returned to sender.
Any refunds will be processed back to the payment method used in the original order. A 20% restocking fee will be assessed on elective returned purchases.
LEREDD will assess each warranty claim, case-by-case. Resolution may include shipment of replacement parts, remote troubleshooting, or replacement with a new or refurbished unit. The limited warranty is generally 12–24 months from purchase date (except accessories, which have no warranty). The limited warranty applies to consumer use only and not to commercial/institutional use.
Customer damage (dropping, misuse, tampering/opening without authorisation) is not covered. Once a product's box seal is opened, it is deemed "open box/used" and subject to applicable restocking fees if returned.
Cables and powerbanks must be handled correctly; damage from strain, pulling, over-powered chargers or misuse is not covered.
Any shipment correctly shipped but refused, undeliverable due to customer-supplied address issues, or returned to our warehouse will incur AUD 200 per carton plus 30% restocking fee; shipping is non-refundable.
Warranty is valid only to the original purchaser if item purchased directly from www.leredd.com or an authorised reseller and is non-transferable.
We aim to process refunds and replacements within 28 days of receipt of the original product, but this may take longer depending on volume.
22. Gift Vouchers and Promotions (Clinic and Products)
Gift vouchers are valid until the expiry date stated and may not be redeemable after that date, subject to applicable laws. Vouchers are non-refundable and cannot be redeemed for cash, except where required by law.
Promotions and special offers are subject to availability and may be withdrawn or varied at any time. Promotions generally cannot be combined with other discounts or offers unless expressly stated.
23. Store Credits (Summary)
Refunds may be made as store credit where appropriate. Store credits are governed by clause 17 above and any specific promotion terms.
24. User-Generated Content and Social Media
By submitting or posting any materials or content on the Website ("User-Generated Content"), you grant to LEREDD a perpetual, irrevocable, royalty-free, worldwide, sub-licensable and transferable licence to use, copy, publish, translate, modify, reformat, create derivative works from, distribute, reproduce and sublicense such materials or any parts of such materials.
You represent and warrant that any User-Generated Content you provide does not violate any law or the rights of any third party and that you have full right to grant this licence.
You understand that all content posted on or via our Website or social media pages is the sole responsibility of the person from whom such content originated. We do not control and are not responsible for content made available through the Website or social media unless it originates from us. You use the Website at your own risk.
You must not post content that you do not have the right to post, is defamatory, misleading, offensive, discriminatory, indecent, infringes intellectual property, contains unsolicited advertising or malicious code, or impersonates any person.
We may pre-screen, refuse or remove any content at our absolute discretion.
25. Intellectual Property
All content, graphics, user and visual interfaces, photographs, trademarks, logos, sounds, music, artwork and computer code, including the design, structure, selection, coordination, expression and arrangement of such material on the Website, is owned, controlled or licensed by LEREDD or third parties and protected by intellectual property laws.
You may not:
- Modify or copy the layout or appearance of the Website or any software/code.
- Decompile/disassemble, reverse engineer or attempt to access any source code related to the Website.
If you correspond with us, you grant us an irrevocable, perpetual, non-exclusive, royalty-free worldwide licence to use that content, including for testimonials and service improvements.
26. Privacy and Personal Information
If you provide us with any personal or health information, our Privacy Policy will govern how we will use or disclose that information. By using our Website, purchasing from us or attending our clinic, you consent to our handling of your information in accordance with that Policy.
27. Clinic Photography, Children, Companions and Conduct
With your separate written consent, we may take before-and-after photographs for your clinical file and/or marketing purposes. You may withdraw marketing consent at any time for future use, noting that existing materials may not be able to be withdrawn.
For safety and infection control, children and companions may be restricted in treatment areas and must follow staff instructions at all times. We reserve the right to refuse service or ask a person to leave the premises in cases of abusive, threatening or inappropriate behaviour, or where we consider treatment unsafe or unsuitable.
28. Disclaimer and Limitation of Liability
To the fullest extent possible at law, we exclude all liability to you or anyone else for loss or damage of any kind or nature relating in any way to the Website, our products, our clinic or services, including but not limited to loss or damage you might suffer as a result of:
- Errors, mistakes or inaccuracies on the Website or our social media pages.
- You acting or not acting on any information contained on or referred to on the Website and/or any linked site.
- Personal injury or property damage of any nature resulting from your access to or use of the Website or attendance at our clinic.
- Any unauthorised access to or use of our secure servers and/or personal or financial information stored on those servers.
- Any interruption or cessation of transmission to or from the Website.
- Any bugs, viruses, trojan horses or other harmful code which may be transmitted to or through our Website by any third party.
- The quality of any product or service of any linked sites.
We do not warrant, endorse, guarantee or assume responsibility for any product or service advertised or offered by a third party through the Website or any linked site.
Where the law (including the ACL) provides a guarantee which may not be lawfully excluded, our liability will be limited to the minimum extent permitted by law (for example supplying the services again or paying the cost of supply again; repairing, replacing or refunding the goods).
Except as required by law, in no event shall we, our affiliates or suppliers be liable for any special, incidental or consequential damages arising out of or in connection with the Website, our products or services.
You agree to accept sole responsibility for the legality of your actions under laws that apply to you.
29. Indemnity
You will at all times indemnify, and keep indemnified, us and our directors, officers, employees and agents from and against any loss (including reasonable legal costs and expenses) or liability incurred or suffered arising from any claim, demand, suit, action or proceeding where such loss or liability arose out of, in connection with or in respect of your conduct or breach of this Agreement.
LEREDD reserves the right to assume control of the defence of any third-party claim subject to indemnification by you, in which event you will cooperate with us in asserting any available defences.
30. Transfer and Assignment
In the event that we merge, sell or otherwise change control of our company, business or Website to a third party, we may disclose personal information and other data we have collected about you to that third party and assign the benefit of this Agreement without notice to you.
31. General
We will not be liable for any delay in performing any obligation under this Agreement if such delay is caused by circumstances beyond our reasonable control.
If any part of this Agreement is found to be void, unlawful or unenforceable, that part will be severed and the remainder will continue in force.
If we do not exercise or enforce any right or provision, it will not constitute a waiver. Any waiver must be in writing and signed by us.
